Introduction
Koble Systems, Inc. d/b/a Koble (“Koble" or “we" or “us”) respects your privacy and are committed to protecting it through our compliance with this policy.
This policy describes the types of information we may collect from you or that you may provide when you use software licensed by Koble (the “Software”), and information we may collect from you when you use Koble software (the “Software”), and our practices for collecting, using, maintaining, protecting, and disclosing that information.
This policy applies to information we collect:
- through use of the Software and related maintenance releases and updates.
This policy does not apply to information collected by:
- us on our website, which has its own privacy policy;
- us offline or through any other means, including on any other software operated by any third party (including our affiliates and subsidiaries); or
- any third party (including our affiliates and subsidiaries), including through any application or content that may link to or be accessible from or in the Software.
Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Software. By accessing or using the Software, you agree to this privacy policy.
Children Under the Age of 13
Our Software is not intended for children under 13 years of age. No one under age 13 may provide any personal information to or through use of the Software. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information in this Software or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will use commercially reasonable efforts to delete that information. Information We Collect About You and How We Collect It
We collect several types of information from and about users of our Software, including information by which you may be personally identified, such as name, postal address, e-mail address, telephone number, or any other identifier by which you may be contacted online or offline ("personal information"). We may collect this information:
- directly from you when you provide it to us;
- automatically as you use our Software.
- from third parties (or example, our business partners).
The information we collect on, through, or in relation to our Software may include:
- information that you provide by filling in forms in our Software. This includes information provided at the time of registering to use our Software, subscribing to our services, posting materials, or requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us and when you report a problem with our Software;
- records and copies of your correspondence (including email addresses), if you contact us;
- your responses to surveys that we might ask you to complete for research purposes;
- details of transactions you carry out through our Software and of the fulfillment of your orders (however, we do not collect payment information regarding transactions and shall not be responsible for any actions or inactions of the transaction data processor);
- your search queries in the Software;
- settings configured by users which govern the operation of the Software;
- information you provide when solicited by the Software, to help improve the Software and diagnose errors;
- any other information you voluntarily provide to us.
As you navigate through and interact with our Software, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:
- details of your use of our Software, including navigation data, location data, logs, and other communication data and the resources that you access and use in our Software;
- information about your computer and internet connection, including your IP address, operating system, version, and browser type;
- username(s) (anonymized so not personally identifiable);
- software usage logs, such as time, date, frequency and/or generalized nature of activity (e.g., created a Sales Order), and error reports -- including any error message displayed to the user;
We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking) that are used in connection with the Software.
The information we collect automatically is generally statistical data, but may also include personal information or we may maintain it or associate it with personal information we collect in other ways or receive from third parties.
How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information, to:
- provide you with the Software, information, products, or services that you request from us;
- provide you with notices about products that you may purchase, including expiration and renewal notices;
- carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
- notify you about changes to our Software or any products or services we offer or provide though it;
- verify license compliance;
- bill according to actual usage (where applicable);
- improve our customer support processes;
- measure general usage patterns;
- identify and fix problems in the Software;
- proactively identify when you are encountering difficulties using the Software;
- in any other way we may describe when you provide the information;
- to contact you about our own and third-parties' goods and services that may be of interest to you;
- for any other purpose with your consent.
Disclosure of Your Information
We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.
We may disclose personal information that we collect or you provide as described in this privacy policy:
- to our subsidiaries and affiliates.
- to contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
- to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Koble’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Koble about our Website and Software users is among the assets transferred.
- to third parties to market their products or services to you if you have consented to these disclosures. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them.
- for any other purpose disclosed by us when you provide the information.
- with your consent.
We may also disclose your personal information:
- to comply with any court order, law, or legal process, including to respond to any government or regulatory request.
- to enforce or apply our terms of service, Software license agreement, and other agreements related to your use of the Software.
- if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Koble, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
Terms Specific to Payment-Facilitation Services
If you have purchased payment- facilitation services through Koble, you will be required to agree to terms with Koble's third party payment-facilitation partner ("Payment Facilitator"). You agree that Koble has no liability related to payment-facilitation services with respect to either the performance and quality of the services themselves, or with respect to transaction data transferred to and from the Payment Facilitator and other parties involved in payment processing. As between Koble and Payment Facilitator, you will look solely to Payment Facilitator under the terms of your agreement with them for satisfaction of any claims related to payment-processing services. Further, you agree that Koble may provide the following datapoints to the Payment Facilitator or other parties involved in processing payments you receive with respect to any transaction the Payment Facilitator facilitates on your behalf:
- Sales tax amount
- Order number
- Item description
- Commodity code
- Product code
- Item price
- Item discount
- Quantity
- Unit of measure
- Item total
- Shipping amount
- Duty amount
- Order discount
- Tax
Choices About How We Use and Disclose Your Information
We strive to provide you with choices regarding the personal information you provide to us. We will comply with your requests for us to stop sending you promotional materials, and will comply with your requests to opt out of Koble using your data. However, please note that Koble’s primary use of your data is always to provide services to you, so an opt out request may disrupt your ability to use Koble services.
We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.
Data Retention
If your contract for the use of Software ends, we will retain your data for up to one hundred eighty (180) days. After this time, we will delete your data from our live systems. Your data may continue to be stored in our backup systems, but will be retained by Koble solely for archival purposes.
Data Security
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls.
Unfortunately, the transmission of information via the internet is not completely secure. The safety and security of your information also depends on you. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through the use of the Software. Any transmission of personal information is at your own risk and we shall not be responsible for data breaches, transmission issues, fraud and/or email compromise. We are not responsible for circumvention of any privacy settings or security measures contained in the Software.
Changes to Our Privacy Policy
You agree that we may make changes to this Privacy Policy. If we do so, we will notify you of the changes by requiring you to agree to the updated policy on your next login to the Software.
